Tim McGraw has filed a countersuit against Curb Records, the Nashville record company that helped launch his career nearly 20 years ago but that McGraw now says wants to enforce his “involuntary servitude” by trying to keep him under a long-standing contract.
It’s the latest legal twist in one of the longest-running country music industry relationships in Nashville — one that made McGraw a star, spawned numerous hit songs and earned both parties millions of dollars before turning ugly.
McGraw is seeking unspecified punitive damages against Curb Records, an advance payment for his latest recordings and a legal ruling he has fulfilled the terms of his contract at Curb and is free to move on.
“After a nearly 19-year relationship with Curb Records which has provided unprecedented success for both parties, Curb has taken actions that are harmful to Tim McGraw’s career,” a McGraw spokesman said. “It is with great regret that he responds with a countersuit, but the label has left him with no other option.”
The relationship soured in recent years, with McGraw publicly railing at the terms of his Curb contract. It came to a head two weeks ago when Curb Records, headed by music mogul Mike Curb, filed a breach of contract suit against McGraw.
The legal dispute centers on McGraw’s latest album, Emotional Traffic, which the singer called his “absolute last album with Curb if it kills him.”
Meanwhile, Curb officials complained McGraw “dumped” the album on the record label.
The label claims McGraw is obligated to record two more albums with the label. McGraw’s countersuit claims he has fulfilled terms of the deal and should be released.
While McGraw’s attorneys don’t dispute that the recordings were made in late 2009 and 2010, during the period his album Southern Voices was released, they dispute that the contract requires him to record songs in a specified time period.
Curb attorney Jay Bowen said the contract’s language is clear, and that McGraw’s legal filing is an admission he didn’t fulfill the terms of that deal.
“Tim McGraw has admitted he did not comply with the recording contract that clearly sets out when he must record,” Bowen said.

Trace Adkins and Little Big Town have joined the lineup for Music Builds: CMT Disaster Relief Concert on Thursday, 12 May 2011. As previously reported, the roster will also include Hank Williams Jr., Alabama, Ronnie Dunn, Sara Evans, Alan Jackson, Lady Antebellum, Tim McGraw and Keith Urban. ESPN reporter Erin Andrews, HLN anchor Robin Meade and comedian Ron White will serve as co-hosts. Filmed without a studio audience, the special will air live from Nashville at 9 p.m. ET/PT on CMT and will be simulcast on CMT.com. All money raised will benefit the American Red Cross disaster relief efforts for people affected by the recent devastating storms, floods and tornadoes.

Country music stars Keith Urban, Tim McGraw, Lady Antebellum, and Hank Williams Jr. are to hold a concert to raise funds for victims of storms and tornadoes that struck Alabama and nearby states.
CMT and organizers said they felt the devastation was overshadowed by media coverage of the British royal wedding of Prince William and Kate Middleton, and news that a U.S. strike team killed Osama bin Laden in Pakistan.
"The other seismic news events of the past few days have had the unintended effect of limiting media coverage of this massive, historic American disaster," CMT President Brian Philips said in a statement.
CMT will air the benefit concert live from Nashville, Tennessee, on 12 May 2011. All money raised will benefit American Red Cross disaster relief efforts.
About 350 people were killed last week by tornadoes and flooding in the southern United States. More than 230 people died in Alabama alone.
Williams, the 61 year-old son of late country music legend Hank Williams, took the first steps to organizing the benefit concert when he reached out to CMT executives.
The 90-minute concert will also feature Ronnie Dunn, formerly of the duo Brooks & Dunn, singer Sara Evans, Alabama and others.
The storms are estimated to have destroyed or damaged more than 13,000 homes across six U.S. states, according to the American Red Cross.

SiriusXM is celebrating 10 years of broadcasting country music with a Tim McGraw concert in New York City.
The satellite radio network said that McGraw will headline a special concert at the Beacon Theatre on 27 April 2011. Luke Bryan and The Band Perry will open for McGraw.

Tim McGraw and Faith Hill received one of five humanitarian awards 2 March 2011 at the Country Radio Seminar convention in Nashville.
Trace Adkins presented them the awards, mentioning their help during May's Nashville floods along with their Neighbor's Keeper Foundation, formed to help people in need and strengthen communities.
"Being honored for our humanitarian work, while incredibly humbling, is also bittersweet for us because it comes at the expense of others who are suffering through hard times," Hill said. "People just like us - with families, brothers, sisters, children and friends - need our help. People with or without homes, with or without jobs, with or without families, the fact is that uncontrollable and unforeseen disasters are not discriminating." McGraw dedicated the award to "people who help other people."
